Charles Kimmett has been identified as "a go-to attorney in business law" and "the kind you’d go to war with." Complex Civil Litigation. Mr. Kimmett’s civil litigation practice includes complex business disputes, contract disputes, allegations of breach of fiduciary duties, royalty disputes, and unlawful termination. He has substantial experience in suits involving the enforcement of preliminary agreements, teaming agreements, and letters of intent. Mr. Kimmett’s notable civil litigation matters include:

Obtained favorable result for client alleging breach of a $37 million teaming agreement after a ten-day arbitration in Washington, D.C.;Part of the team that obtained one of the largest Privacy Act recoveries and the complete vindication of client wrongly accused of the 2001 anthrax attacks;Defended national entertainment company in suit alleging breach of license agreements and royalty contracts after a three-day arbitration in New York;Obtained reversal of default judgment and dismissal of action against foreign country sued for alleged trademark violations; andObtained reversal of decision denying client award of specific performance of preliminary agreement for the purchase and sale of a $50 million hotel.

Trial Litigation. Mr. Kimmett counsels clients in resolution of complex business disputes, shareholder departures, business valuations, and review of litigation funding opportunities. When litigation is necessary, he has substantial trial experience in federal and state court and before arbitration tribunals. In addition to the above, Mr. Kimmett’s trial litigation experience also includes:

Winning the dismissal of a Section 1983 action brought against a top-20 law firm;Defending claims alleging breach of a teaming agreement on statewide fiscal agent project; andObtaining orders in multiple Federal District Courts requiring disclosure of anonymous sources, information thieves, private investigators, and other actors who defamed or damaged individuals and businesses through unlawful acts.

Telecommunications Disputes. Mr. Kimmett has extensive experience in the field of telecommunications regulation, representing clients before the Federal Communications Commission on matters involving tariff violations, program access complaints, retransmission consent agreements, interconnection and special access, and number porting.

Internal Investigations. Mr. Kimmett engages in internal investigations on matters involving potential consumer and bank fraud, regulatory violations, criminal misconduct, and regulatory and Congressional investigations. He represents trade associations in subpoena response and compliance matters. He represented a client in testimony before a Congressional oversight committee.

Prior to joining the firm, Mr. Kimmett was a Notes Editor on the Yale Law Journal and published a Note and two Book Notes on labor and mass tort law. He then clerked for Justice Stewart G. Pollock of the New Jersey Supreme Court and was a trial litigator at Williams & Connolly LLP.
